Morris & Morris leads Liberty Mutual to victory against Royal American Management, et al. 14 February 2012

Federal District Court Judge Richard Smoak today awarded Liberty Mutual Insurance Company damages of… $195,243.90 in a case in which Liberty Mutual sought to recover unpaid workers’ compensation premium pursuant to a high-deductible policy Liberty had issued to several Panama City-area defendants. After a bench trial, the Court held that the Royal American defendants had not shown that Liberty mishandled the claim driving the premium and awarded all damages sought in the complaint. The Royal American defendants have appealed the Court’s decision to the Eleventh Circuit- watch for briefing on the issue of claims handling in the context of loss-sensitive workers’ compensation policies.
